Bossman’s Bargains Terms of Service

Welcome to Bossman's Bargains! Before you proceed to access the full range of services and content available within our server, you (the “User”) are required to read, understand, and agree to the following terms and conditions. By accessing or using the Bossman’s Bargains Discord server (the “Server”), you signify your agreement to these Terms of Service (the "Agreement"). If you do not agree to these terms, you must not access or use our services.

1. Server Access and Usage
1.1. By joining the Server, you acknowledge that the Server’s primary purpose is to facilitate discussions, provide exclusive deals, and foster a community. You agree to use the server only for its intended purposes and abide by all guidelines set forth for community interaction.

2. No refunds
2.1. All contributions, donations, or purchases made to, and within, the Server are final and non-refundable unless an extreme circumstance warrants so. This policy applies to all transactions conducted through the Server.

3. Code of Conduct
3.1. All members must always adhere to Discord’s Terms of Service (https://discord.com/terms) and Community Guidelines (https://discord.com/guidelines) while participating in our server. Failure to comply with Discord's policies will result in disciplinary actions, up to and including a ban from our server.
3.2. All members and staff are to be treated with respect and dignity. Harassment in any form, including but not limited to bullying, discrimination, or personal attacks, is strictly prohibited. Violations may result in immediate disciplinary action, up to and including a mute or blacklist from our services.
3.3. Any form of spamming, unsolicited advertising, and promotional activities, including but not limited to direct messaging (DM) members without their consent, are strictly forbidden.
3.4. The discussion, promotion, or endorsement of any fraudulent or illegal activities, including but not limited to exploiting customer service policies for refunds, coupons, or sharing unauthorized methods, is strictly prohibited.

4. Intellectual Property and Privacy
4.1. All codes, content, and materials provided within the server are proprietary and confidential. Distribution, sharing, selling, or leaking of such materials to non-members, non-subscribers, or any unauthorised individuals is strictly prohibited and may result in disciplinary action. Module trading is only permitted between premium members and must take place within Discord direct messages. Free members may not participate in trades, and no financial gain may be involved in any exchange.

5. Use of Server Software
5.1. Abuse or misuse of the Bossman’s Bargains Software, including but not limited to the automated services provided within the server, will not be tolerated. Any attempt to manipulate, hack, or exploit these services will result in disciplinary action. Prohibited behaviours include, but are not limited to: posting duplicate success entries, reposting another user’s success, submitting irrelevant or misleading success entries, or deleting a success post in order to unfairly redeem rewards (such as a 14-day extension or a cooldown reset). Such actions will be considered abuse of the system.

6. Violations and Disciplinary Actions
6.1. If any breach of these Terms of Service is detected, we reserve the right to terminate your membership without a refund, and disciplinary actions against you which may include but are not limited to: being blacklisted from the Server’s community, being temporarily restricted from using the Bossman’s Bargains service, and restriction from using public community rooms.

6.2. Administrators reserve the right to take any actions they deem necessary and appropriate to enforce the Server’s rules and Terms of Service, including actions not explicitly outlined in this document.

6.3. Staff reserve the right to take any action they deem necessary including, but not limited to, issuing warnings, timeouts, or bans.

6.4. Please note that these terms are not exhaustive, and staff reserve the right to exercise discretion in all situations.

7. Communications
7.1. By joining our service, you consent to receive electronic communications from Bossman's Bargains, which may include membership updates, marketing emails, payment reminders, and other service-related notifications. You may opt out of receiving certain communications as provided in our Privacy Policy.

8. Modification of the Agreement
8.1. We reserve the right, at our sole discretion, to modify or replace these Terms of Service at any time. If a revision is material, we will make reasonable efforts to provide notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

9. Dispute Resolution and Arbitration Agreement
9.1. Informal Negotiation: To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms of Service (each a "Dispute" and collectively, the “Disputes”) brought by either you or us (individually, a “Party” and collectively, the “Parties”), the Parties agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below) informally for at least thirty (30) days before initiating any arbitration. Such informal negotiations commence upon written notice from one Party to the other.
9.2. Binding Arbitration: If the Parties are unable to resolve a Dispute through informal negotiations, either Party may elect to have the Dispute (with the exception of those Disputes expressly excluded below) finally and exclusively resolved by binding arbitration. ANY ELECTION TO ARBITRATE BY ONE PARTY SHALL BE FINAL AND BINDING ON THE OTHER. The arbitration shall be conducted under the rules of the London Court of International Arbitration (LCIA) or another recognized provider mutually agreed upon by the parties, and if the parties are unable to agree on a location, the arbitration shall be conducted online or via telephone, or at a location determined by the arbitrator or arbitration service provider that takes into account the geographical location of the parties. The arbitration shall be conducted in the English language by a single arbitrator mutually agreed upon by the parties. The decision of the arbitrator shall be final and binding on the Parties, and the award of the arbitrator may be entered as a judgment in any court of competent jurisdiction.
9.3. Restrictions: The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
9.4. Exceptions to Informal Negotiations and Arbitration: The Parties agree that the following Disputes are not subject to the above provisions concerning informal negotiations and binding arbitration: (a) any Disputes seeking to enforce or protect, or concerning the validity of, any of the intellectual property rights of a Party; (b) any Dispute related to, or arising from, allegations of theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief.
9.5. Costs of Arbitration: The Parties shall bear their own costs related to the arbitration proceedings, including legal fees, except as otherwise determined by the arbitrator.
9.6. Changes to this Arbitration Agreement: Notwithstanding the provisions of section 8.1 regarding modifications to these Terms of Service, if Bossman's Bargains changes this Arbitration Agreement, you may reject any such change by sending us written notice within thirty (30) days of the change, in which case your account with Bossman's Bargains shall be immediately terminated and this arbitration provision, as in effect immediately prior to the amendments you reject, will survive.
9.7. Severability: If any part or parts of this Arbitration Clause are found under the law to be invalid or unenforceable by a court of competent jurisdiction, then such specific part or parts shall be of no force and effect and shall be severed and the remainder of the Clause shall continue in full force and effect.

10. User Eligibility

10.1. By accessing the Server, you confirm that you are at least 13 years old (or the minimum age required by law in your jurisdiction to use Discord). You also confirm that you are legally permitted to enter into this agreement and are not prohibited from receiving or accessing the Server’s services under applicable laws or regulations.

11. Account Security and Responsibility

11.1. You are responsible for maintaining the confidentiality of your Discord account credentials and any actions taken under your account. If you suspect unauthorized use of your account, you must notify an administrator immediately.

11.2. Bossman’s Bargains is not liable for any loss or damage arising from your failure to comply with this responsibility.
